피고인은 2019. 10. 20. 06:20경 성남시 중원구 H 앞 노상에서 술에 취해 주차된 차량에 기대어 있던 피해자 I(가명, 여, 21세)을 발견하고 다가가 “술 많이 먹었어요 ”라고 물어보아 피해자가 답변하지 아니하자 “커피 한잔 하자, 방 잡아놨다”라고 하며 피해자의 팔을 잡아끌어 강제로 모텔로 데리고 들어가려고 하였고, 피해자가 피고인의 팔을 뿌리치고 도망가려 하자 피해자를 뒤따라가 피해자를 뒤에서 두 손으로 껴안아 반항하지 못하게 한 후 손으로 피해자의 가슴을 주무르며 “흥분된다. 빨리 들어가면 안 되냐 ”라고 하고, 피해자의 질 내에 피고인의 손가락을 넣고, 피해자의 손을 끌어 피고인의 성기를 만지게 하였다.
