Reasons
1. Case summary
A. 1) On October 28, 2015, the Defendant: (a) against the Plaintiff on the Intellectual Property Tribunal on October 28, 2015, the name “NFC (NFC)” is a patented invention (registration number: No. 12607, patentee: the Plaintiff and the instant patented invention) that is “the device and method of a personal identification number” (registration number: No. 12607, 12607, hereinafter referred to as “the instant patented invention”).
(2) On February 29, 2016, the Plaintiff filed a request for correction of the claims of the instant patent invention during the procedure for invalidation of registration (hereinafter “instant request for correction”) with respect to the invalidation of registration under Article 1, 3, 5, 6, and 9 of the claims.
3) On June 8, 2016, the Intellectual Property Trial and Appeal Board recognized the instant request for correction as legitimate, and recognized the claim scope 1, 3, 5, 6, and 9 of the instant patent invention for which the Defendant accepted the Defendant’s request for trial and requested correction (hereinafter “instant Claim Nos. 1, 3, 5, 6, and 9”).
