Reasons
1. Basic facts
A. C sold each of the above land to Defendant B and completed the registration of ownership transfer on June 28, 2003 under the name of Defendant B on May 2009, and on October 9, 2003, the name of the building owner was changed to the name of Defendant B on each of the 1,076 square meters of G 1,076 square meters (I 619.4 square meters of land was later designated as Hsart, and I 619.4 square meters of land) of the 1,076 square meters of land in Busan-gun-gun, Busan-gun, which is his own ownership.
B. Defendant B’s aforementioned construction on October 28, 2003, Co., Ltd., Ltd. (hereinafter “Woman Construction”).
The construction work of the two buildings listed in paragraph (1) (hereinafter referred to as the "officetel of this case") is to be contracted with the construction cost of KRW 4,058,450,000. While J is to carry out the construction work as the site manager, the construction work is suspended due to the non-payment of the construction cost of Defendant B, etc., and the construction of Defendant B and Preferential Construction was completed on March 25, 2004.
C. After that, on April 22, 2004 between K, L, M, and N (the above four persons hereinafter referred to as "K et al.") introduced by J for the purpose of carrying out the construction work directly through J, the Defendant B continued to carry out the construction work with the same business agreement with the Defendant B, stating that "the gains from the completion of the instant officetel shall invest the construction capital to Defendant B, and the gains from the completion of the instant officetel shall be 30% to Defendant B, and the dividends of 70% to 3 others, respectively," and on September 6, 2004, K et al. completed the registration of ownership transfer on the instant land, which is the site of the instant officetel, in the name of L andO for the purpose of securing the above investment capital.
On August 11, 2004, the site of this case was commenced at the request of the Dong Busan Agricultural Cooperative.
