A defendant shall be punished by imprisonment for not less than two years and six months.

However, the execution of the above punishment shall be suspended for four years from the date this judgment becomes final and conclusive.

Punishment of the crime

Around May 2019, the Defendant received a proposal from E to “to open a passbook as the representative of a juristic person and to pay consideration,” and accepted it, the Defendant established a juristic person under the name of “G” and opened an account in the name of the juristic person under the name of the Defendant, and was to sell the passbook, cash card, authorized certificate, OPT card, etc. connected with the account.

1. On June 25, 2019, the Defendant: (a) conducted an event, such as false entry in public electronic records and records; (b) did not intend to actually operate a corporation; (c) had access to the Internet registry site of the Supreme Court; and (d) had access to the Internet registry site of the Supreme Court on June 25, 2019 and entered “E”, “G”, etc. in advance; (c) had a public official in charge of the Seoul Central District Court enter the above facts in the Commercial Computer System from the time when the application was filed by means of digital signature and approval; and (d) had a public official in charge of the said commercial act enter the aforementioned facts in the Commercial Computer System of 10,000 won in the total amount of capital; and (e) had a public official in charge of the said commercial act enter the aforementioned facts in the Commercial Computer System of 28,000,000,000 won; and (e) had a public official in charge of the said commercial act enter them in the Commercial Computer System of 15 days and 205 days.

Accordingly, the Defendant, in collusion with E and G, has a special media record such as electronic records identical to the authentic copy of a notarial deed.
