A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. No person who violates the Public Performance obscenity and Child Uniforms Act (or sexual harassment, etc. against a child) shall commit sexual harassment, etc. that causes a child to feel sexual humiliation;

A. On April 3, 2016, around 12:45, the Defendant disembarked from three female students of elementary schools, such as D (n, 11 years of age) at a park play area in Jung-gu Incheon Metropolitan City, Jung-gu, and disembarked from their gender.

B. On March 19, 2017, around 14:10 on March 19, 2017, the Defendant disembarked four female students of elementary schools, such as E (n, 11 years of age), in the vicinity of women’s toilets in Jung-gu Incheon Metropolitan City, with their gender.

Accordingly, the Defendant committed sexual abuse, such as sexual harassment, which makes a child feel sexual humiliation at the same time twice as above.

2. Around March 19, 2017, the Defendant violated the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes (hereinafter “Special Cases Concerning the Punishment, etc. of Sexual Crimes”) and the Act on the Punishment, etc. of Children’s Uniforms (sexual harassment, etc. against children) committed an act of self-defense in C female toilets located in Jung-gu Incheon, Jung-gu, Incheon, by reporting the form of self-defense as described in paragraph (b) E, etc. as described in paragraph (1) 1(b) of the Defendant’s No. 1, and avoided it into the above toilet, and then, the Defendant committed an act of self-defense by entering his hand into one toilet.

Accordingly, the defendant infringed on public toilets for the purpose of meeting the sexual desire as above and abused sexual harassment that causes sexual humiliation to children.
