2. Determination

A. The establishment of facts constituting an offense in a criminal trial ought to be based on strict evidence with probative value, which leads a judge to have a reasonable doubt, insofar as the prosecutor’s proof does not sufficiently reach the extent that such conviction would lead to such a conviction, even if there is doubt of guilt, such as the defendant’s assertion or defense is inconsistent or unreasonable, it should be determined in the interests of the defendant.

As evidence consistent with the facts charged in this case, G’s statement evidence (G’s legal statement, police’s statement, written statement), witness H’s legal statement, victim’s photograph, medical expenses statement, medical expenses payment certificate, and medical record copy.

However, in light of the following circumstances that can be recognized as a result of the examination of evidence by this court, the above evidence alone is insufficient to recognize the facts charged of this case.

1. The witness H’s testimony shall not be trusted, such as being inconsistent and contradictory as follows:
