A defendant shall be punished by imprisonment for not more than ten months.
Of the facts charged in the instant case, Articles 1 and 1 of the List of Crimes against Victims C.
Reasons
Punishment of the crime
The Defendant is operating D Co., Ltd. (hereinafter referred to as “D”) that acts as a broker for passenger taxi services and pays profits with fees from taxi companies.
1. Fraud against the victim E [2017 highest group 2355] Defendant is the victim E and the elementary school alumni.
A. On March 2015, the Defendant entered into the first investment agreement with the purport that “If the cost of installing a device in a taxi company is KRW 10 million in the first set of 10 million, the principal would be returned in two years thereafter, and the monthly income would be paid in KRW 500,000 per set.”
However, the defendant did not have any intent or ability to invest the money in the business of installing a device only when the victim has invested money.
Defendant deceptioned the victim as above and acquired the victim’s total sum of KRW 20 million on March 23, 2015, and KRW 20 million on March 27, 2015, under the pretext of investment in the installation of a full period of time from the injured party.
B. On June 2015, the Defendant entered into the secondary investment agreement with the purport that “70% of the investments made by investing one set shall be guaranteed from Gwangju City as subsidies, and the remainder 30% shall be guaranteed by receiving the principal from the taxi company and shall be paid KRW 500,000 per set.”
However, even if the victim invested money, the defendant did not have any idea to invest in the business of installing the device, and there was no decision to pay the subsidy in Gwangju City.
The defendant deceivings the victim as above and acquired money from the victim with the name of 10 million won under the name of the investment money in the installation of authentic season around June 16, 2015.
2. Fraud against the victim C [2017 highest 2839] The Defendant, even though his/her spouse was legally married, shall have internal relationship with the victim C from December 2014.
