A defendant shall be punished by imprisonment for six months.
Reasons
Punishment of the crime
"2017 Highest 1797"
1. On July 4, 2017, the Defendant embezzled the property that he/she had in mind used without following necessary procedures, such as returning it to the victim, even though he/she acquired one physical card of a national bank lost by the victim E in front of D located in Busan Shipping Daegu C, on the following day: (a) around July 4, 2017; and (b) he/she embezzled the property that he/she has left the possession of the victim.
2. On July 4, 2017, the Defendant violated the Act on Financial Business Specializing in Fraud and Credit Financial Business: (a) purchased shower 10,000 won in the H administered by the injured party G in the first floor of the Busan Shipping Daegu FFF in Busan, and (b) presented the Defendant’s physical check card obtained in the name of E, as described in the foregoing paragraph 1, to pay the amount.
As such, the Defendant: (a) by deceiving the victim; (b) obtained the delivery of goods equivalent to KRW 10,000 from the injured party; and (c) used the e-mail card, including the use of the lost e-mail card; and (d) purchased the total amount of KRW 250,040 on 11 occasions as indicated in the list of crimes in the attached Form.
3. On July 13, 2017, at around 21:00, the Defendant invadedd the Defendant’s residence by entering the victim’s residence without permission by using the entrance and password, which he/she became aware of while lodging in the above room room, as well as entering the victim’s house without permission, at around 21:12 on the 15th of the same month, around 20:59 on the 19th of the same month, around 09:34 on the 15:0 on the 19th of the same month, around 15:00 on the 21st of the same month, and around 15:00 on the 21st of the same month, via the same five times in total.
4. On July 24, 2017, the Defendant: (a) around 19:45, at the “M” coffee shop located in Busan Shipping Daegu L; (b) opened a coffee ordered by the injured party N, who was a customer; and (c) opened a door on the table on the table; and (d) opened the door on the table.
