피고인은 2016. 5. 17. 20:10경 광주시 북구 B에 있는 C 앞 버스정류장에서 D 시내버스에 승차하여 그 곳에 있던 피해자 E(여, 21세)를 보고 추행할 것을 마음먹고, 피해자에게 접근하여 피고인의 성기 부위를 피해자의 허벅지 부위에 밀착시키고 이를 비볐다.
