All appeals by the Defendants are dismissed.

1. The summary of the grounds for appeal is that the Defendants may not call with C or come to contact with C.

Nevertheless, the court below erred by misunderstanding the fact that the defendants and C have conspiredd to intentionally commit a traffic accident and to acquire vehicle repair costs and agreement money.

2. Determination

A. According to the evidence duly adopted and examined by the court below, the following facts can be acknowledged.

1) C) On February 18, 2017, around 01:15, 2017, E NAS-PE NAE (hereinafter “instant NAS”).

2) Defendant A driver’s vehicle FMW (hereinafter “instant BMW”) of Defendant A driver’s license, who was directly engaged in a tamp from the old parallel distance to the front parallel distance and was directly engaged in a tweon from the tweon surface to the tweon surface while driving a tweon and straighted from the tweon surface to the tweon surface.

) The occurrence of the collisioned traffic accident (hereinafter “instant accident”) has occurred.

(2) At the time of the instant accident, the instant BMW conflict with the fence of the protective fence between the road and India. At the time of the instant accident, Defendant A, B, and D were on board. (2) At the time of the instant accident, the instant NAW had been equipped with a black box, but all did not operate.

3) Once driving the instant NAS at the location of the instant accident and the instant accident, C had been engaged in U Uton around approximately 100 meters away from the surface of the H maintenance industry company. The CCTV installed in front of the H maintenance industry company had Uton over three times on February 18, 2017, for which the NAS had been 0:58, 01:06, 01:08, and 01:08 U.S. had been left, and the images directly prone to the site of the instant accident were destroyed due to the instant accident.
