Punishment of the crime
Defendant
A is the representative of the LAB, and the defendant B is a corporation that imports products, such as the Domination of China.
No person shall make a false declaration on the dutiable value or tariff rate in order to affect the determination of the amount of customs duties when he/she files an import declaration on goods from overseas.
1. Defendant A
A. On July 28, 2011, Defendant A evaded customs duty evasion of KRW 102,796,124 (a total amount of KRW 1,064,446,497 (a total amount of KRW 1,064,497) to be actually imposed on the imported goods by the same method as in the calendar table 1 as in the attached crime list 1, even though the actual unit price was 8.96 US dollars at the time of filing an import declaration, while the actual unit price was 8.96 US dollars at the time of importing the Republic of Korea from China to China.
(b) Defendant A evaded dumping duties by abusing the fact that the anti-dumping duty is imposed on the anti-dumping goods from China, and the anti-dumping duty is imposed differently from the minimum of 9.14% to the maximum of 29.41% on each producer, thereby attempting to evade customs duties corresponding to this by falsely filing an import declaration with the relevant forged producer, notwithstanding that the goods are not produced by the Chinese F, on which the anti-dumping duty is imposed at a minimum of 10.26% of the low dumping duty rate, as if they were F products, by falsely filing an import declaration with the relevant forged producer.
Accordingly, on July 20, 201, the Defendant imported the amount equivalent to USD 15,206 of the U.S. dollars for other goods of the Republic of Korea in China from among importation declaration number G on July 20, 201, and filed a false import declaration with a customs office using evidentiary documents forged in F, thereby evading KRW 946,193 equivalent to the difference in the rates of duty for anti-dumping duty to be imposed actually, as shown in the attached list 2 of crime sights.
