A defendant shall be punished by imprisonment for not more than ten months.
Reasons
Punishment of the crime
1. On December 16, 2013, the Defendant used K’s identification card in the “N” mobile phone sales agency operated by the victim M in Gyeyang-gu Incheon, Gyeyang-gu L, and the fact is considered to have received a mobile phone device and sold it to another person, and thus, the Defendant did not intend or have the intent to purchase the mobile phone normally, but the above victim stated that “I would like to open the mobile phone in the name of K, which is the O father, on behalf of the victim, in lieu of the occurrence of the damage.” The Defendant obtained one of the mobile phone sales agencies in the name of 1463,00 won from the victim and acquired it by fraud.
2. On or around December 16, 2013, around the 19th day of the same month, the Defendant used P’s identification card, and around the 28th day of the same month, at the “N” mobile phone sales agency of the above victim’s M, the fact was received a mobile phone terminal and thought it to sell it to another person and did not have an intention or ability to purchase the mobile phone normally, but the above victim’s “I want to use the mobile phone under his mother’s P name because of night work, I would like to open the mobile phone under the above P’s name.” In addition, I received three mobile phones from the victim, respectively.
3. Criminal acts using Qua identification cards;
A. On January 6, 2014, the Defendant forged private document forgery and the display of the falsified Private Document, stating Q’s “R” in Q and the resident registration number column to the purchaser column for the purpose of using the mobile phone opening at the N’s mobile phone sales agency operated by the above M with the intent to use the mobile phone opening, and subsequently forged one copy of the application form in Q’s name, which is a private document on the rights and duties, by means of signing Q Q in the subscriber column, and exercised the said M with the falsity as if it was genuine.
