1. The Defendant’s KRW 50 million and its relation to the Plaintiff is 5% per annum from January 31, 2009 to November 25, 2015.
Reasons
1. Basic facts
A. The defendant and his husband, C (hereinafter referred to as the "the defendant's husband and wife"), among the real estate listed in the separate sheet (hereinafter referred to as the "the real estate in this case"), had the land listed in paragraph (1) in the name of the defendant, as to the land listed in paragraph (2), as to the land listed in paragraph (2), and as to the land and building listed in paragraphs (3) and (4), as to the mutual accommodation facilities, the "Dur" has been owned in the name of the defendant, and as to the land and building listed in paragraphs (4), around September 2005, the repair work was undertaken for the "Dur", and as to the new construction of a new lodging facility (hereinafter referred to as the "new accommodation in this case") on the land listed in paragraphs (1) and (2) of the annexed sheet adjacent thereto,
B. On September 16, 2005, E entered into a sales contract with the Defendant couple to purchase the instant real estate at KRW 2.143 million (hereinafter “instant sales contract”) and agreed as follows.
(1) The down payment of KRW 220 million shall be paid on the date of the contract, and the balance of KRW 1.923 billion shall be paid until October 30, 2005.
(2) After paying the down payment, the buyer commences the construction work on his/her responsibility, and receives a written waiver of the construction cost from F, a repairer.
C. E paid a down payment of KRW 220 million to the Defendant couple on the date of the contract, and continued construction of the new building of this case, but the remainder was not paid until October 30, 2005, which is the remainder payment date. On December 23, 2005, E paid an additional amount of KRW 517 million to the Defendant couple, at the same time, paid a C’s loan obligation of KRW 962,039,546 on behalf of the Defendant couple, and settled as follows.
In other words, E is a KRW 737 million (the contract amount of KRW 220,000,000 paid on December 23, 2005) paid at KRW 2.143 billion, and the principal and interest of the agricultural loan of KRW 962,040,00,000 paid by E, and the interest of KRW 930,082,00,000,000,000,000 paid at KRW 2.143 billion,000,000,000,000,000,000,000,000.
