A defendant shall be punished by imprisonment for six months.

Punishment of the crime

From May 2015 to January 2016, the Defendant, “2017 Senior 3679,” had been working as an insurance designer at the third floor of Jongno-gu Seoul, Jongno-gu, Seoul, the third floor of the building, and C has concluded an entrustment contract with the victim D Co., Ltd. (hereinafter “victim”) and had been in charge of insurance brokerage business.

When the Defendant concludes an insurance contract in a formal manner without any intent to buy the insurance contractor's genuine insurance contract and the Defendant maintains the insurance contract between several months by paying insurance premiums in large installments, the Defendant has expressed the fact that the insurance designer who arranged the insurance contractor's solicitation and the conclusion of the insurance contract from the damaged company is paid allowances according to the performance of the contract formation and maintenance.

Accordingly, the Defendant, at the above branch office around January 9, 2015, filed a claim for allowances with the victim company by pretending that E was the contractor and the insured without the intent of E to subscribe to the F goods of the victim company, and received KRW 3,766,828 as an allowance for around February 25, 2015 from the employees in charge of the victim company who may be aware of such circumstances, and received KRW 81,270,293 in total as allowances from the victim company 19 times in the same manner from September 25, 2015, as shown in the attached crime list, from September 25, 2015.

The Defendant of “2018 Highest 499” was D Co., Ltd. from January 2015 to April 2015, and from May 2015 to January 2016, C Co., Ltd. to May 2015 to January 2016, and C Co. is a company that entered into an entrustment contract with D Co., Ltd. for insurance brokerage business.

Any person engaged in the conclusion or solicitation of insurance contracts shall be in connection with the conclusion or solicitation thereof.
