Criminal facts No. 1, 4 through 9 of the judgment of the defendant are punished by imprisonment for 8 months, and criminal facts No. 2. of the judgment.
Reasons
Punishment of the crime
On August 27, 2020, the Defendant was sentenced to 8 months of imprisonment with prison labor and 2 years of suspended execution on September 4, 2020 by the Ulsan District Court on August 27, 2020.
1. On March 11, 2020, around 13:37, the Defendant obstructed the victim’s historical management work by means of force between about 20 minutes, including: (a) the Defendant passed through the subway 2 line D, the Busan subway 2, where the victim C was working as the service personnel in Busan Northern-gu, Busan, without paying the fee, and (b) the Defendant was at risk of suffering from the damage; and (c) the Defendant was at risk of suffering from the damage, thereby obstructing the victim’s historical management work by force.
2. 가. 피고인은 2020. 10. 8. 10:10 경 부산 북구 B에 있는 부산 지하철 2호 선 D에서, “ 남자 역무원이 손님! 을 더럽게 쳐 다 본다!! ~~”, “ 이 지역 거지 똥개들 눈깔!! 이 ~~ 남의 마누라 육신!! 을 계속~~~ 훔쳐보고 변태적으로 서 있다!! ~~” 라는 내용의 글씨를 검정색 매직으로 써 벽면의 미관을 해치는 등 그 효용을 해하였다.
B.
