The judgment of the court below is reversed.
A defendant shall be punished by imprisonment for six months.
Reasons
1. The summary of the grounds for appeal is too unreasonable that the sentence imposed by the court below on the defendant (eight months of imprisonment).
2. The crime of this case is deemed to have been unlawfully used by the Defendant over 21 times, and there are significant circumstances such as the occurrence of harm, such as the occurrence of the harm of the vehicle registration license plate and the massing of the term “motor vehicle”, and the frequency of crimes, etc., which are disadvantageous to the Defendant. However, while the Defendant acknowledged the crime of this case, the Defendant made efforts to transfer the motor vehicle sold by the Defendant to the actual owner in the future, scrap or recover it, etc., the Defendant appears to have voluntarily surrendered to the investigation agency as to the crime of this case, and other various circumstances, including the motive and circumstance leading up to the crime of this case, the means and method leading up to the crime of this case, the situation before and after the crime, the Defendant’s age, character and conduct, occupation, and family relation, etc., the punishment imposed by the lower court is too unreasonable.
3. If so, the defendant's appeal is reasonable, and the judgment of the court below is reversed in accordance with Article 364 (6) of the Criminal Procedure Act, and the following is ruled again after pleading.
[Discied Judgment] The summary of facts constituting an offense and evidence recognized by the court is identical to the description of each corresponding column of the judgment below, and thus, it is acceptable to accept it as it is in accordance with Article 369 of the Criminal Procedure Act.
