1. The plaintiff's claim is dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

1. Basic facts

A. On August 25, 2012, the Defendant, who operated C (hereinafter “C”), was the introduction of D, the general headquarters of the Plaintiff Company, to work as the Plaintiff’s representative director E on August 25, 2012, and worked at Samsung SSI, the site where the Plaintiff Company is running the project from around 27th of the same month.

B. From September 2012, the Plaintiff Company contacted with G, etc., the team leader of the said company, to participate in the “PLM project” for the advancement of the drawing and document management overall system (hereinafter “PLM project”). On November 7, 2012, the Defendant, who was in charge of the announcement of the project proposal opened at the office of the Korea Fractional Industry on November 7, 2012, provided that the team leader, etc. used the strike points data prepared in the name of C as his/her representative, and that, on November 28, 2012, the Plaintiff Company, who is not the Plaintiff Company, respondeded to any question about whether C, other than the Plaintiff Company, will proceed with the FF Team staff of the Korea Self-Employed Industry, may clearly change the position of the Plaintiff Company to the effect that the Plaintiff Company’s response proposal, such as the response to the project proposal, was the main body of the PLM’s response to the Plaintiff Company’s request.

C. The Plaintiff Company did not receive a contract for the PLM project, and the Defendant retired from the Plaintiff Company as of March 15, 2013.

The company filed a criminal complaint against the Defendant on the ground that the Defendant had C, not the Plaintiff Company, obtain business opportunities when explaining the proposal of the Korea Single Industrial Business, and the Defendant issued a summary order of KRW 5 million as Seoul Central District Court Decision 2013 High Court Decision 2013 High Court Decision 2013 High Court Decision 31630,000.
