Reasons
Punishment of the crime
From January 20, 2010, the Defendant is a public official of Grade V in contractual service in charge of the training of its players and the participation in the competitions while serving as a supervisor of culture, tourism, sports and B team C in Seo-gu Incheon Metropolitan City.
1. Fraud;
A. The Defendant, from August 23, 2011 to September 5, 2011, was aware that the D player affiliated with the Seo-gu Incheon Metropolitan City Office participated in the strengthening training against the participation in the national sports meets within the year 2011 after the completion of the 2011 EM and returned home for three days.
Nevertheless, even though D players did not actually provide accommodation for three days from September 5, 201 to September 19 of the same month (14th 15th ambling), D players filed a false claim for accommodation expenses of KRW 90,000 for three days (30,000/1 day) of D players to the Seo-gu Incheon Metropolitan City Office on October 5, 201, and received the above KRW 90,000 from the Seo-gu Office around that time.
B. From September 11, 201 to September 13, 201 of the same month, the Defendant and players, who were supervisors from September 11, 201, were unable to take leave during the training period from September 12, 2011 to September 13 of the same month. Notwithstanding the fact that the Defendant and players left a training site without permission and did not take a leave and provide accommodation and meals, they obtained 80,000 won, food expenses, 70,000 won, and 290,000 won, including accommodation expenses for five players, from the Seo-gu Incheon Metropolitan City office around October 5, 201, and obtained 290,000 won, from the Seo-gu Office, for the Defendant’s accommodation expenses and meals.
(c) On October 30, 201, the 30th National Schools and the Vocational Team G Games (from October 28, 201 to November 6 of the same year) were actually conducted for the joint adaptation training and participation in the field of literature in the Nam-gu Incheon Metropolitan City, Dongdaemun-gu.
