1. The plaintiff's claim is dismissed.

1. Details of the disposition;

가. 원고는 경북 칠곡군 B 답 4,851㎡ 2014. 12. 29. 그 중 43㎡가 E에 이기 중 1,654㎡, C 답 1,309㎡ 중 37㎡, D 답 314㎡ 중 218㎡, F 답 489㎡ 중 95㎡, G 답 69㎡ 중 15㎡ 합계 2,019㎡(별지 1 도면 표시 ㉠, ㉡, ㉢, ㉣, ㉤, ㉥, ㉦ 부분, 이하 ‘이 사건 신청지’라 한다)에 관하여 다음과 같은 건물의 신축을 목적으로 농지전용허가ㆍ개발행위허가 및 건축허가 신청(이하 건축허가 신청을 ‘이 사건 신청’이라 한다)을 하였다.

B. On December 19, 2014, the Defendant rejected the instant application from the Plaintiff on the following grounds:

(hereinafter “instant disposition”). - The instant application concerns development activities - An area requiring planned and systematic management as “a planned and planned control in consideration of an area expected to be integrated into an urban area or natural environment” - In an area where infrastructure, such as water supply and sewerage, is not secured (i) pollution of nearby farmland may occur due to water supply and sewage, etc. such as manufacturing facilities, and a residential environment in nearby areas may fall (ii) and a residential environment in rural communities may fall (ii). (iii) In the future, there is concern that the surrounding landscape and rural living environment may be impeded in the village center (iii) - In relation to farmland diversion - The infrastructure following the construction of the application site, which is the criteria for examination under Article 33(1) and (2) of the Enforcement Decree of the Farmland Act, is formed into a collective farmland in rural village, and thus the value of nearby farmland is preserved as farmland.
