A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On December 22, 2008, the Defendant was sentenced to a fine of one million won due to a violation of road traffic law (drinking driving) in the Daegu District Court Kimcheon-cheon branch on December 22, 2008, a fine of two million won by the same court on March 21, 201, and a fine of five million won by the same court on July 12, 201.

Although the Defendant had been punished twice or more due to drinking driving as above, on November 5, 2017, at around 19:50, the Defendant driven B rocketing car under the influence of alcohol with approximately KRW 0.177% alcohol content from the 20km section to the innovative underground vehicular road located in Kimcheon-si, Kimcheon-si.

The records of the crime as indicated in the grounds for sentencing Article 62-2 of the Criminal Act, the time of the crime, the numerical value of alcohol concentration in blood, the background of the crime, reflectivity, the fact that there is no criminal record exceeding fines, and other circumstances, such as character and conduct, environment, etc. of the defendant, shall be determined as the same as the order;
