1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. On November 3, 1999, the Defendant entered into an insurance contract with the Plaintiff on the attached list that guarantees the expenses of disease, injury, hospitalization, etc. with the insured as the Defendant (hereinafter “instant insurance contract”).
B. On September 8, 2006, the Defendant received insurance proceeds of KRW 41,492,180,00 on the ground that the Defendant received hospitalized treatment for 25 days at B Hospital due to tension, and received KRW 220,000 according to the insurance contract of this case from the Plaintiff, as indicated in Table 1 below (hereinafter “instant insurance accident”).
