A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant is a person engaging in driving a rocketing car.

On February 5, 2016, the Defendant, without obtaining a driver’s license for a motor vehicle from around 22:00 on February 5, 2016, driven the said motor vehicle under the influence of alcohol level of 0.089% during blood, and led it to the direction of drinking distance from the middle of the drinking market.

At all times, there was a duty of care to safely drive a motor vehicle by reducing the speed or temporarily stopping the motor vehicle to a person engaged in driving a motor vehicle without signal at the intersection.

Ultimately, the Defendant by occupational negligence inflicted injury on the victim E and the victim I (the 54 years old), who was on board the said rocketing car, to the victim I (the 54 years old), including the impairment of the character of the head and other parts requiring treatment for about two weeks, and at the same time, destroyed the repair cost equivalent to KRW 2,671,339, such as the exchange of the front driver of the rocketing car, and the repair cost equivalent to KRW 4,482,179, such as the exchange of the front driver of the rocketing car, and escaped without taking necessary measures such as relief.
