The prosecution of this case is dismissed.

1. On May 14, 2015, the Defendant: (a) 00:30 on May 14, 2015, in front of the first floor of the building in Jung-gu, Busan, the Defendant: (b) assaulted the victim’s neck with a breath hand on the right hand part of the victim D (nick, 20 years old); (c) obstructed the victim’s neck on the right hand; and (d) obstructed the victim’s stroke on the upper part of the building in Busan.

2. This constitutes a crime falling under Article 260(1) of the Criminal Act, which cannot be prosecuted against the victim’s express intent under Article 260(3) of the same Act. The victim D appeared in this court on April 18, 2016 after the prosecution of this case as a witness and expressed his/her intention not to punish the defendant. The prosecution of this case is dismissed pursuant to Article 327(6) of the Criminal Procedure Act.
