1. The defendant shall be punished by imprisonment for eight months;
2.Provided, That the execution of the above sentence shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
On September 17, 2015, the Defendant: (a) completed a marriage report with the victim C (V) on September 17, 2015; and (b) concluded a divorce agreement with the victim C (V) on the grounds of differences in nature on February 7, 2017; (c) “The right to care for the victim D is vested in the victim C; (d) the parental authority is jointly exercised; and (e) the Defendant may hold an interview with the victim from February 1, 2017 to December 31, 2017; (e) however, the dispute with the victim C while living together with the victim for a marital life again from March 3, 2017, was brought up separately from the victim C, resulting in the victim C having his/her own custody again on April 29, 2017.
Accordingly, the defendant forced the victim C to bring the victim D and his own care.
1. On May 11, 2017, at around 15:13, 2017, the Defendant: (a) reported on May 15:13, 2017; (b) around the first floor of Busan Shipping Daegu E-1st, Busan, the Defendant: (c) reported the victim C to board the elevator with the victim C, and attempted to take the victim C’s hair c from the victim C’s hand to get off the victim’s hair; (d) tried to keep the victim C from the victim’s hand; and (e) continued to get out of the elevator at the third floor above the upper floor; (e) prevented the victim’s body from spreading, plucking, or digging up the victim’s body; and (e) prevented the victim’s abduction from being carried out by his hand; and (e) tried to capture the victim D from the victim C to a minor who the victim protected C, but did not report to the police officer having attempted to move out the elevator to the police officer without having been called out.
2. In the above time, place, and the victim C attempted to get D from the victim, but the victim resisted against the victim, as mentioned above, the victim suffered the injury.
