A defendant shall be punished by imprisonment for not less than one year and six months.
However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
A false statement was made to the victims to the effect that “a loan would be made at low interest if an existing loan is repaid,” while misrepresenting the employees of the financial institution, and then the Defendant contacted the victims through the telegram Megsens and instructed the victims to receive cash in the name of the existing loan repayment from the victims to transfer the account without a passbook. The Defendant, in compliance with the foregoing direction, conspired with the victims to transfer the remaining money except the cash received from the victims to the place where the victims were notified of the non-resident, and then, to the account designated by the non-resident.
1. On May 12, 2020, the victim F made a false statement to the effect that “The victim F is a staff member of the G Bank H. It is expected to make a loan at a low interest rate if repayment of KRW 10 million is made to the existing I Bank.” On May 18, 2020, the Defendant made a false statement to the effect that “The victim is a debt collection employee of the I Bank. It has collected KRW 10 million from the victim before Kim Jong-si, Kim Jong-si, and then remitted the remainder of KRW 975 million, excluding KRW 250,000,000,000 from the victim, to the account designated by the deceased.”
2. On May 25, 2020, the victim K’s false statement to the effect that “the victim is a member of L bank M... to be a member of the existing N bank will be given a loan at low interest if a loan is to be paid at a low interest rate of KRW 9.6 million to the existing N bank.” The Defendant, around 15:40 on May 27, 2020, made a false statement to the effect that “the victim is a member of the N Bank’s debt collection.” The Defendant collected KRW 9.6 million from the victim’s passenger car parked on the road front of the Hongsung-gun PP ceremony at Hongsung-gun OP hall around May 27, 2020.”
