1. Basic facts

A. The Plaintiffs are entrepreneurs who are engaged in activities such as household water, rain, etc., and Defendant NVV Ltd. The Defendants asserted that the lawsuit of this case was unlawful since the Plaintiffs’ legal representative did not directly delegate the lawsuit from the Plaintiffs, but delegated the lawsuit from the entertainment planning company to which the Plaintiffs belong. Since the above entertainment planning company did not receive delegation authority from the Plaintiffs, the lawsuit of this case was filed by a person who did not have the right of representation.

The existence of the power of attorney is an ex officio matter of the court, and if the power of attorney is a private document, whether the court should issue a certification order with respect to the certification of the power of attorney belongs to the discretion of the court.
