1. The Defendant’s KRW 168,00,000 as well as 5% per annum from March 10, 2017 to December 21, 2017 to the Plaintiff.
Reasons
1. Basic facts
A. On July 9, 2012, the Defendant entered into a real estate security trust agreement with the land trust company, Daegu Livestock Industry Cooperatives, and Masung Livestock Industry Cooperatives as the first priority beneficiary, and completed the registration of ownership transfer as to the instant commercial building on the same day, on the ground of trust in the future, a land trust company for the instant commercial building.
B. 1) On June 3, 2016, the Defendant: (a) prepared a sales contract with the purchaser as the Plaintiff and the Plaintiff’s wife as to the instant store; and (b) KRW 630 million with the purchase price as the Plaintiff and the purchaser as the Plaintiff; and (c) prepared the sales contract with the purchase price as KRW 630 million (hereinafter “instant sales contract”).
(2) On July 15, 2016, Nonparty E agreed to pay KRW 120 million on the date of the contract, the remainder of KRW 510 million on the date of the contract, and the remainder of KRW 510 million on the date of the contract. Nonparty E deposited KRW 120 million to the Defendant on the same day.
3) As to the instant sales contract, a sales contract and a sales contract with the Defendant and the Plaintiff, the date of the preparation of which was changed on June 23, 2016, and the date of the remainder payment was changed on July 28, 2016, and the sales price was changed to KRW 630 million as is, and the sales price was changed to KRW 6220 million as is, and the date of the preparation and the date of the remainder payment was made on June 3, 2016 and July 15, 2016. The final date was made on September 5, 2016, and the sales price was KRW 620 million (payment of KRW 1220 million on the date of the contract, KRW 50 million on October 31, 2016). The Defendant finally prepared a sales contract that was to be issued to the Plaintiff as required to receive the remaining ownership transfer as mentioned above, and the Defendant shall deliver the remaining ownership transfer to the Plaintiff.
Matters of special agreement
1. The seller will be liable and named for the present possessor by the remaining date of the balance.
