The prosecution of this case is dismissed.

1. The summary of the facts charged is the director of technical division C(State) in Ansan-si, the defendant, and the victim D is the director of the branch of the National Democratic Chemical Textiles Trade Union Co., Ltd.

On June 5, 2015, around 08:20 on June 5, 2015, the Defendant made a request to the victim, who had talked with members of the technical research institute office in the above C(State).

Although the victim requested to show regulations without complying with the request, the victim stated that "I am, I am, I am, I am, I am, I am, while the employees belonging to the technical research institute are observed."

Accordingly, the defendant openly insultingd the victim.

2. We examine the judgment. This is a crime falling under Article 311 of the Criminal Act, which can be prosecuted only upon a victim’s complaint under Article 312(1) of the Criminal Act. According to the statement of withdrawal of the victim’s complaint filed in the records, D, the complainant, after the prosecution of this case, can find the fact that he revoked the defendant’s complaint on January 7, 2016, which is the date of the prosecution of this case. Thus, the above facts charged constitute revocation of the complaint for a case which can be prosecuted only upon the complaint, and thus, the prosecution is dismissed pursuant to Article 327 subparag. 5 of the Criminal Procedure Act.
