1. The Defendant’s KRW 59,800,000 as well as the Plaintiff’s annual rate from March 27, 2016 to June 7, 2017, and the following.

1. Basic facts

A. The Plaintiff contracted the following construction works from the Defendant.

Of the construction work during the construction period of Category B B B housing (B), the construction work during the construction period of the contract date for the construction work of the Corporation (B) shall be KRW 20,000,000 (excluding value-added tax) on October 22, 2015, January 30, 2016; and KRW 32,00,000 per square meter (excluding value-added tax) among the construction works for new housing of 2C on January 15, 2016, among the construction works for new housing of the Corporation (hereinafter “instant construction works”);

B. The Defendant paid money to the Plaintiff as indicated in the following table (hereinafter “instant table”).

Serial 11,00,000 on December 16, 2015; 3,000 on January 26, 2016; 3,000,000 on January 26, 2016; 4,000 on February 6, 2016; 5,000,000 on February 6, 2016; 10,000 on February 24, 2016; 10,000 on June 6, 200, 200 on June 3, 2016; 10,000 on June 6, 200, 200 on July 10, 2007; 10,000,00 on March 10, 2016; 10,000 on April 10, 200, 2009;

C. The Corporation completed before January 30, 2016, and the Corporation completed the instant construction on or around March 26, 2016, and it decided to waive and succeed to the said construction between the Plaintiff, Defendant, and E.

2. The parties' assertion;

A. The Plaintiff’s assertion - The construction cost of the instant construction is KRW 177,800,000 finally, and the Defendant paid the Plaintiff the construction cost of the instant construction by the sequence 3,5,6,7,8,8,10,000 in total, KRW 79 million,00,000,000,000 in total, as the construction cost of the instant case was paid to the Plaintiff. Accordingly, the unpaid construction cost is KRW 98,88

The plaintiff shall seek partial claims for the payment of KRW 59.8 million and damages for delay. -

Although the Defendant alleged that the entire amount indicated in the instant table was paid as the construction cost of this case, the money listed in Nos. 1, 2, 4, and 9 of the instant table was received as the construction cost of B, and the money listed in Nos. 12 and 13 of the instant table was DB.
