1. The description of the claim is as shown in the annexed sheet of claim

(2) Article 208(3)3 of the Civil Procedure Act provides that “The cause of the instant claim was stated as a bill bond at the first date for pleading.”

3. On June 30, 2017, the Plaintiff seeking a payment for delay from June 30, 2017, the due date of the bill. However, since the bill is a certificate of presentment, the Plaintiff is not liable for delay due to the due date, and is liable for delay from the date of receipt of the bill. The Plaintiff’s claim for delay from the due date to the date of delivery of a copy of the bill is rejected, on the grounds that there is no evidence that the Plaintiff presented the bill to the Defendant and sought payment on the due date.
