Punishment of the crime

However, even if the defendant received the price of goods from the victim, he did not have the intention or ability to sell it.

By November 30, 2019, the Defendant, by deceiving the victim as such, received KRW 335,00 from the E-association account (F) in the name of the Defendant on the same day from the victim, and received KRW 1,958,800 in total from 18 victims over 18 times in the following manner as in the list of crimes in attached Form 19.

around December 7, 2019, the Defendant posted a letter that he sells ‘H panty panty tampet' on the Internet site G and said that he would send a ticket if he transfers the transaction money to the victim I who contacted with him.

However, the defendant had no intention or ability to sell goods from the beginning.

As such, the Defendant, by deceiving the victim, received KRW 30,00 from the victim via the K Bank account (L) in the name of the J Company K in the same day.

around December 7, 2019, the Defendant posted a letter to the effect that he/she sells “M contact pockets” at the Internet site G, and reported it to the victim N who contacted with him/her and sent the ticket “to send the ticket if he/she transfers the ticket value.”

However, even if the defendant receives the payment from the victim from the beginning, he did not have any intention or ability to send contact diskettes.

As such, the Defendant, by deceiving the victim, received KRW 20,00 from the victim to the account under the name of J company K (L) on the same day.
