Each public prosecution of this case is dismissed.
Reasons
1. Facts charged;
A. From July 2012 to September 2012, 2012, wages of 2.550,000 won are unpaid.
(b) Unpaid retirement allowances of 27,900,530 won and retirement allowances of 775,530 won for workers E; and
2. Dismissal of public prosecution;
A. On June 25, 2013, after the indictment of this case, a written withdrawal of each complaint containing employee E- and employee D’s expression of intention not to punish the Defendant on June 26, 2013, which was filed after the prosecution of this case.
(b) Grounds: Article 109(2) and (1), and Article 36 of the Labor Standards Act; proviso to Article 44 of the Guarantee of Workers' Retirement Benefits Act; proviso to Articles 14 and 9 of the Act; Article 327 subparag. 6 of the Criminal Procedure
