1. The judgment of the first instance, including the Plaintiff’s respective claims added by this court, shall be modified as follows.
Reasons
1. Facts of recognition;
A. The Plaintiff is the owner of the land listed in [Attachment List No. 2 (hereinafter “instant site”) and the land listed in [Attachment List No. 1] adjacent to the instant site (hereinafter “the instant dry field”).
B. On April 16, 2004, the Defendant purchased a building listed in attached Table No. 3 (hereinafter “instant building”) on the instant site from the Plaintiff’s DozD, and completed the registration of ownership transfer on April 20, 204.
C. On February 12, 2007, the Defendant leased the instant site from the Plaintiff as KRW 84,000 per month of rent (payment on February 30, 2007) for 12 months from February 12, 2007.
(hereinafter referred to as “the lease of this case.” Since then, the Defendant, on the instant site, has installed and owned 12 square meters of the half-frames on the ground, in addition to the instant building; and 54 square meters of the instant dry field on the ground, in each of the (a) parts of the instant dry field; and has occupied and used (a) parts of the instant site and (b) parts of the instant dry field until now.
The Plaintiff requested the Defendant to increase the monthly rent from the rent for August 201 to the monthly rent of KRW 244,000 per month from the previous monthly rent of KRW 84,00,000 on July 201, but the Defendant did not comply therewith.
E. The Defendant did not pay rent from July 2013 to June 2015.
On June 30, 2015, the Plaintiff sent to the Defendant a certificate of content that contains an expression of intent to terminate the instant lease agreement on July 1, 2015, on the grounds of the Defendant’s delinquency in paying two or more rents, and around that time, the Plaintiff reached the Defendant’s certificate of content.
F. The rent for each period from January 1, 2011 to June 7, 2017 of the instant building is as follows:
The monthly rent for each period of time (hereinafter referred to as "original unit") shall be 270,540,540 3,246,480 on December 31, 201, for the monthly rent for the period of January 1, 201 to December 31, 201, and 239,760 2,7602,87,120 on January 1, 201 to December 12, 201, respectively.
