A defendant shall be punished by imprisonment for not less than one year and six months.

Punishment of the crime

[Criminal Power] On April 22, 2020, the Defendant was sentenced to one year by the Daejeon District Court for a violation of the Electronic Financial Transactions Act, and is currently pending in the final appeal trial.

[2] No person may keep, deliver, or distribute a means of access for electronic financial transactions in exchange for consideration.

On February 2, 20108, the Defendant listened to the phrase, “in the form of a passbook and a physical card to reduce the documents pertaining to the opening of an account; 100,000 won per account; 100,000 won per account, each account is opened by receiving a document from a person with no name, and sent to the person with no name, and received 10,000 won per account.”

On February 26, 2018, the Defendant received documents necessary to open a “stock company C” account from a person who was unaware of his/her name on the road prior to the scarcity branch in Gwanak-gu in Seoul Special Metropolitan City, and received two passbooks, C, and OPT cards in the name of the said corporation, and delivered the means of access by receiving 100,000 won in cash from the person who was unaware of his/her name.

Around February 2018, the Defendant listens to the phrase “10,000 won per each account shall be given in 100,000 won per each page of the dry-gu, Seoul.” Around April 27, 2018, at the digital branch of Guro-gu, Seoul, to the G Bank of Korea, the documents necessary for the opening of the corporate account in the name of “H” from a person who has no title to his/her name, and received two copies of the physical check card for two accounts of the G Bank in the name of the said legal entity, and received two copies for each account, together with the head of the Tong-gu, and the OTP creation machine.
