A Imprisonment for six years, each of the defendants B, C, and D shall be punished by imprisonment for five years.

Punishment of the crime

To the extent that the Defendants’ exercise of their defense rights is not practically infringed, part of the records in the indictment was modified.

The Defendants are friendly-gu, and the victim E (the family name, the age of 19) is a high school-friendly district such as Defendant A, and the other Defendants first met the victim on the day of the instant case.

On January 2, 2014, Defendants A and D were gathered at the house of Defendant C, which is the F apartment G of Yeongdeungpo-gu, Young-gu, Sin-si, G around January 2, 2014. Defendant A and Defendant D promised to drink with the victim at a drinking time, and she was in the vicinity of the victim’s “H point”, and when the victim was unable to drink with the victim during that process, Defendant A and Defendant D got the victim at the house of the above Defendant C with Defendant B and Defendant C.

On January 3, 2014, the Defendants entered a room in which the victim diversed at the house of the above Defendant C around January 3, 2014, and avoided tobacco in front of the entrance, and Defendant A conspired with the victim to have sexual intercourse with the victim as stated in the following: “I would like to report sexual intercourse with the victim to the effect that I would have been sexually disturbed. I would have sexual intercourse with the victim. I would have sexual intercourse with the victim. I would like to see the victim in the way coming at C’s house. I would have sexual intercourse with the victim.”

B, Defendant C, and Defendant D, who led to the fifth trial of this Court on October 10, 2019, led to the confession of the crime, but not explicitly and previously recruited as the facts charged.
