Defendant shall be punished by a fine not exceeding five million won.

Where the defendant fails to pay the above fine, 50,000 won shall be one day.

Punishment of the crime

Around January 201, B, etc., the Defendant: (a) sent text messages to many unspecified persons to make loans by taking advantage of a mobile phone as security; and (b) had no intent or ability to make loans even if a mobile phone was delivered to the victims, the Defendant decided to provide a mobile phone counselor with a knowledge that the profits have been secured by the method of disposal of the mobile phone after receiving a mobile phone from the victims, despite having no intention or ability to do so.

B et al.: (a) one-time telephone consultation call center was set up in the officetel near the officetel located in the Nowon-gu, Nowon-gu, Seoul; (b) reported text messages to enable the Defendant to get loans from the Defendant as a telephone counsel staff; and (c) as if the contact would give counseling services to the victims who come from the contact, E obtained several million mobile phone numbers and sent text messages to the victims to open and send them through a mobile phone; (d) received and disposed of text messages, and (e) B conspired to receive and dispose of the mobile phone sent by the victims, and (e) the head of the sales team paid allowances of KRW 8-1 million per mobile phone to the business members.
