Punishment of the crime

[criminal power] On February 16, 2015, the Defendant was sentenced to one year to a suspended sentence of four months for violating the Military Service Act at the Ansan Branch of the Suwon District Court on February 16, 2015, and the judgment was finalized on the 24th of the same month. On March 3, 2015, the Defendant was sentenced to two years of a suspended sentence of six months for fraud in the same court on March 3, 2015

【Criminal Facts】

1. On September 24, 2014, the Defendant: (a) around September 24, 2014, at the “D” mobile phone sales store of the building C in Silung City; (b) without authority, the Defendant, without authority, issued the said application to the said mobile phone sales employee who is aware of the fact at the same time and at the same place, by entering the victim E’s name and personal information in the column of customer information on the application for purchase of the new service site; and (c) signing the victim’s name and forging a copy of the application for purchase of the mobile phone;

In addition, the Defendant forged 37 copies of the application form for the admission of the victim's cell phone with 14 cell phones as stated in the attached list 1.

2. On September 24, 2014, the Defendant: (a) around September 24, 2014, at the aforementioned “D” mobile phone sales store operated by the victim without the above E’s consent; (b) at the same time, the Defendant opened a mobile phone without the said E’s intention to pay the mobile phone price and the fee; and (c) took the same attitude in paying the fee, etc. even if the mobile phone was opened, the Defendant was paid the amount equivalent to KRW 748,00 from an employee who was unaware of the name of the said sales store who believed to do so; and (d) the Defendant used the said mobile phone so that the amount of the fee exceeding KRW 1,

In addition to this, the Defendant acquired the amount of KRW 27,873,243 of the terminal price of the 37 mobile phone and the total amount of KRW 46,378,198 of the user price of the 18,504,955 as stated in the attached list 2.
