A defendant shall be punished by imprisonment for six months.
Reasons
Punishment of the crime
1. On September 5, 2012, the Defendant: (a) obtained a copy of credit card (credit card No. G) of a national bank (credit card No. 1) that was lost by the victim F in the large room in the Dong-gu 4-dong, Daegu-dong, Daegu-dong, Daegu-si, and embezzled the lost possession with the intent of acquisition without taking necessary procedures, such as reporting to the police station; and (b) embezzled the lost possession with the intent of

A. On September 5, 2012, around 00:33, the Defendant purchased two bread and cans located in Daegu Jung-gu H “I” market, and delivered the credit card acquired as above to the victim J as if he/she was his/her own possession, and caused the victim J to settle the price of KRW 8,600 from the victim, thereby defrauding two bread and cans equivalent to that amount.
B. Around 02:00 on September 5, 2012, the Defendant purchased ccarcas (500ml) and one set of ethiopia coffee (275ml) located in Daegu-gu K, Daegu-gu, Daegu-gu, and then acquired two cancass and two cancjus in an amount equivalent to that amount by allowing the Defendant to pay KRW 2,800 from the victim as if he/she owns the F-owned credit card as if he/she owns it.
C. On September 5, 2012, the Defendant: (a) used a taxi in the same Dong-gu, Daegu-gu; (b) provided the credit card acquired as above to the victim as if he were his own possession; and (c) had the victim pay 3,100 won of the taxi fee from the victim; and (d) obtained profits equivalent to the same amount by allowing the victim to pay 3,100 won of the taxi fee.
On September 5, 2012, around 06:40, when using Bari in the N Co., Ltd. located in the Daegu-gu N Co., Ltd., the credit card acquired as above was delivered to the victim’sO as if it were one’s own possession, and such payments were made by allowing the victim to pay 8,000 won of Mariri or usage fee, thereby obtaining profits equivalent to that amount, and continuously purchasing the Mari or entrance fee from the victim.
