A defendant shall be punished by imprisonment for four months.

Punishment of the crime

On April 29, 2016, the Defendant, within the Anyang prison located at 42 Don-ro 508 (Songdong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-dong-

First of all, to lend KRW 10 million to B, the contract will be concluded at the same time as the contract is entered into and the amount of KRW 60 million will be paid.

In order to make a false statement, a written complaint stating that it shall be remitted from the complainant as the borrowed money, but it shall not be changed, so that it shall be punished for fraud.

However, on July 25, 2016, C entered into a material sales contract for selling the sn beam beam beam of H at the above D construction site to E at the purchase price of 270 million won (20 million won for down payment, intermediate payment of 80 million won, and 170 million won for remainder payment). Accordingly, C was remitted from E as down payment on July 25, 2016, KRW 20 million for down payment, and KRW 20 million for intermediate payment on August 1, 2016. Since C received KRW 10 million for intermediate payment from the Defendant upon E’s request from E on the same day, C merely borrowed money for intermediate payment of KRW 10 million from the Defendant.

Nevertheless, on May 3, 2015, the Defendant submitted a false complaint to C by mail to the public service center of the Si-Sung Police Station, which is located in the 513 Si-Sung-ro of Si-Sung-si, Si-Sung-si.

Accordingly, the defendant reported false facts to public offices for the purpose of having C receive criminal punishment.
