1. The Defendants jointly combine the Plaintiff with KRW 100,000,100, and Defendant B Co., Ltd. with respect thereto from May 21, 2015.
Reasons
1. Basic facts (applicable for recognition: Facts without dispute, entry in Gap evidence, evidence Nos. 1, 2, 3, 4, 5, and 10, and purport of the whole pleadings);
A. The Plaintiff is the occupant management committee comprised of the sectional owners of the Atel in Seongbuk-gu, Sungnam-si.
B. 1) Defendant B Co., Ltd. (hereinafter “Defendant Company”).
(3) On December 8, 201, the Defendant Company completed the registration of ownership transfer on the ground of sale by voluntary auction with respect to Nos. 2, E-201, 3, E-301, 3, 3, E-302, 3, 3, 3, E-303, 3, 3, E-305, and 3, 3, 3, 3, 3, 3, 331 among the above officetels on December 8, 201 (hereinafter referred to as the “instant officetels” in combination with officetels the ownership of which the Defendant Company acquired, and, in addition, it is called the “instant head”.
(2) After that, the Defendant Company completed the registration of ownership transfer with respect to subparagraph 201 to D on October 25, 2012, the registration of ownership transfer with respect to subparagraph 201 to E on January 25, 2013, the registration of ownership transfer with respect to subparagraph 301 to Peru on December 27, 2012, and the registration of ownership transfer with respect to subparagraph 302 to F on November 15, 2012, respectively.
C. 1) As to the instant officetel, the Plaintiff obtained a provisional attachment order of 208Kadan3270, May 20, 2008, with the claim amounting to KRW 1.366,789,720, the aggregate of the management expense claims unpaid from August 2006 to March 2008, and completed the provisional attachment registration of the same day, and completed the provisional attachment registration of the same day between April 2008 and January 201, with the Seoul Central District Court 29,223,650, the aggregate of the management expense claims unpaid from April 5, 201, with the claim amounting to KRW 1.36,789,720, and completed the provisional attachment registration on April 5, 201, and completed the provisional attachment registration on the same date) and completed the provisional attachment registration for each of the above registrations for the reason of sale due to the provisional attachment.
3) The management expenses for the section for common use among the unpaid management expenses as above (870,352,560 won) shall be 870,352,560 won.
