Reasons
1. On October 18, 200, the Plaintiff’s summary of the Plaintiff’s assertion received boundary restoration surveying from the Defendant Korea Land and Land Information Corporation (hereinafter “Defendant Corporation”).
The above 5-7 was subject to registration conversion into 470-4, Pyeongtaek-si, Pyeongtaek-dong, and was divided into 470-4 (hereinafter “instant land”) and two parcels, and remains at present.
On January 20, 2015, as a result of the Defendant’s re-survey on the land in this case, it was found that the buildings and fences on the ground of the 470-2 land adjacent to the north-dong, Pyeongtaek-dong, Pyeongtaek-dong, Chungcheongnam-do, were partly infringed on the land in this case.
Therefore, the Plaintiff filed a lawsuit against the owner of the above neighboring land to demand the removal of the building and fence, which partially infringed on the land of this case, but eventually, the Plaintiff lost the Plaintiff’s claim for the prescriptive acquisition by the owner of the adjacent land. The Plaintiff lost the ownership of part of the land of this case.
Ultimately, due to Defendant Corporation’s fault in surveying on October 8, 2000, the Plaintiff could not block the completion of prescriptive acquisition on the ground that he was aware that the fenced by the owner of neighboring land was invaded by the Plaintiff’s instant land.
Therefore, the Plaintiff filed a claim for damages due to tort against Defendant Republic of Korea and Defendant Pyeongtaek-si who committed negligence, such as negligence in the registration and execution of the official cadastral record of the Defendant, which committed negligence in surveying, and the negligence in managing the official cadastral record.
