The grounds of appeal are examined.
For the reasons indicated in its holding, the lower court upheld the first instance judgment that acquitted the Defendant on the charge of violating the Labor Standards Act due to nonperformance of the duty to liquidate money and the violation of the Guarantee of Workers' Retirement Benefits Act.
The judgment below
Examining the reasoning of the record, contrary to what is alleged in the grounds of appeal, the lower court did not err by exceeding the bounds of the principle of free evaluation of evidence against logical and empirical rules, or by misapprehending the legal doctrine on “business or workplace which ordinarily employs not less than five workers” under the Labor Standards Act.
Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
