Defendants are not guilty.
Reasons
On January 24, 2013, Defendant A, in the official lawsuit room, received a summary order of KRW 5 million from the Seoul Central District Court to commit a violation of the Immigration Control Act, and the previous case and two times more.
1. The defendant A shall not employ any foreigner who does not have the status of sojourn eligible for employment activities;
From November 20, 2013 to February 26, 2014, the Defendant employed 13 Chinese nationals and one Vietnamese, who did not have the status of sojourn eligible for job-seeking activities at the construction site of the SK SK Skcheon Apartment apartment in Yong-dong, Incheon, at the intervals of KRW 1.30,00 won per day, as indicated in the attached Table Nos. 1 to 14, as shown in the attached Table Nos. 1 to 2014, the Defendant employed 13 Chinese nationals and one Vietnames, who did not have the status of sojourn eligible for job-seeking activities at the above 14 times from November 20, 2013 to February 26, 2014.
In addition, on February 26, 2014, the Defendant employed Vietnam, 1,40,000 won per day, who did not obtain permission to change the workplace of the apartment construction site at the above apartment construction site.
2. As described in the preceding paragraph, the Defendant Company B employed 15 Chinese workers who were the representative A, who did not have the status of sojourn that the Defendant’s representative A does not have the right to engage in job-seeking activities.
In other words, the circumstances that can be recognized or presumed as follows: ① Defendant B Co., Ltd. (hereinafter only referred to as Defendant B Co., Ltd.) appointed the J executive director at the construction site of the above apartment site to be in charge of the field management; ② The head of the above site management team was appointed at each of the following process, and K and L were appointed as the head of each model team, M as the head of each model team, the head of the steel team, and the NB as the head of the concrete team; and the above head of the team shall pay a certain amount according to the construction size or weight ratio according to each process and pay the wages to the employees following the above specified amount, if any, the amount of the wages, etc. are incurred in excess of the above specified amount.
