A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The total liability of the criminal organization for telecommunications fraud (hereinafter referred to as "scam") consists of various stages such as inducements, solicitations, and remittances for telecommunications fraud crimes. An employee belonging to the inducements is in charge of inducing a victim to transfer money by making false statements, such as inducing him/her to pay deposits, in order to obtain a loan by telephone to the victim by misrepresenting himself/herself. An employee belonging to the solicitations is engaged in soliciting accounts and physical cards to be used for the scam crime, and an employee belonging to the remittances is engaged in the act of immediately settling or withdrawing cash when he/she deposits money in the account, and sending the money to the scam criminal organization.

On January 13, 2020, the name omittedist, who is the Bosing inducement book following the above public offering, falsely speaks to the victim B (son and 50 years of age) by telephone and misrepresenting the C company's staff, and, in order to obtain a loan, he/she shall pay in full the existing loan, at around 15:02 of the same day from the victim, he/she receives 16 million won from the victim to the E-bank (F) account in the name of D at around 15:02 on the same day. On January 14, 2020, he/she assumes the victim as an employee by telephone to the Financial Supervisory Service and, on January 14, 2020, he/she has been transferred from the victim KRW 10,010,000 from the victim to the account in the name of business bank (H) in the name of G around 36 of the same day.

On the other hand, the Defendant agreed with G on January 12, 2020 that “A loan without conditions is made. There is a loan which is now in Daegu and will be talked by going through a direct appearance in the old and present city,” and that the Defendant would attempt to receive a loan.
