A defendant shall be punished by imprisonment for not more than ten months.

Punishment of the crime

After posting an advertisement to attract investors on the Internet, the defendant has attempted to acquire money as investment money from those who wish to report the advertisement and to make an investment.

From October 13, 2011, the Defendant: (a) around October 13, 201, on the advertisement column for the invitation of investors in marketing, such as 'the same life angle' and 'investment market', the Defendant placed an advertisement for the invitation of investors in marketing, 1:1 advertising using the marketing rather than simple online sales. In the case of the first month sales due to the open market sales, the first month sales are KRW 60,000,000, and 1:1 sales, from the first month of the first month to the 6th month of the first month; and (b) the average sales begin from the 7th month of the first month to the 6th month, and the average sales begin to begin, an average sales amount to KRW 6.40,000,000 per month. The sales including the open market will be KRW 700,000.7 billion per month.

On October 24, 2011, the Defendant made a false statement to the victim C, stating that “The investment expenses will be fully returned within three months from the cellphone online sales store and withstanding.”

However, even if the money is invested from the victim, there was no intention or ability to carry out the business by entering into a consignment sales contract from the mobile carrier.

The Defendant received 1,345,00 won on the same day as the investment money from the victim.

In addition, from around that time to November 25 of the same year, the Defendant received a total of KRW 55,903,760 over 20 times as shown in the list of crimes in the attached Table as an investment deposit.

Accordingly, the defendant was given property by deceiving the victim.
