A defendant shall be punished by imprisonment for six months.
However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. Around 02:00 on March 31, 2013, the Defendant: (a) embezzled a victim’s personal card (a passenger aboard a taxi operated by the Defendant) prior to the Down-si station located in Seopo-si C, without following necessary procedures, such as acquiring a new card under the victim’s wife E, lost; and (b) returning it to the victim; and (c) embezzled the victim.
2. Fraud and violation of the Specialized Credit Finance Business Act;
A. On March 31, 2013, at around 02:01, the Defendant: (a) provided that, while filling LPG gas to a taxi operated by the Defendant in the Ggas filling station located in Seopopo City F, the Defendant would have the right to use the credit card acquired by the Defendant to the victim H; (b) deceiving the victim by issuing the sales slip after signing the sales slip; and (c) received the supply of LPG gas equivalent to KRW 30,000 from the victim.
B. On March 31, 2013, the Defendant purchased goods such as tobacco, etc. from J, Inc., Ltd., Ltd., located in Seopopopo City I, and presented as if he/she had the right to use the credit card of B acquired as above, and deceiving the victim by way of issuing sales slips after signing the sales slips, and received goods such as tobacco, etc. equivalent to KRW 42,00,000 from the victim.
C. On March 31, 2013, around 10:19, the Defendant purchased gold papers from L L in Seopopo-si L, and presented as if the Defendant had the right to use the credit card acquired B with the victim N as above, and deceiving the victim by signing a sales slip and then delivering it, and one of them was issued by the victim at KRW 790,000 of the market price.
The Defendant, around 10:55 on March 31, 2013, presented that the Defendant purchased one gold-rum from the P bank located in Seopo-si P, Seopo-si, P, as if he had the right to use the credit card acquired as above, to the victim Q Q, and then signed the sales slip and issued it to the victim.
