1. Of the judgment of the court of first instance, the part against the defendant exceeding the following amount ordered to be paid shall be revoked.
Reasons
1. Basic facts
A. The Plaintiff is a mutual aid business entity that has entered into a mutual aid agreement with respect to a large bus for E (hereinafter “instant bus”), and the Defendant is a driver of C,00 air (hereinafter “instant tent”).
B. On October 17, 2014, around 15:50 on October 17, 2014, the Defendant: (a) driven the instant tent and turned the said road into a road in the front of the Jeonnam-gun-gun-gun land located in the Gumri-ri-dong Middle School; (b) there was an accident that conflicts with the protruding part of the instant bus’s right side with the protruding part of the instant tent (hereinafter “instant accident”).
C. Due to the instant accident, F and 24 persons on board the instant bus (hereinafter “the instant victims”) were on board the instant bus. D.
Under a mutual aid agreement, the Plaintiff paid the victims of the instant case a total of 35,794,436 won as shown in Table 1 below under the pretext of medical expenses, lost earnings, and consolation money.
