1. The plaintiff's claim is dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

1. Basic facts

A. In order to implement an urban development project with respect to land of 520-3 square meters and 96,500 square meters, Dong-dong, Ulsan-gu, Ulsan-do (hereinafter “instant urban development project”), the Plaintiff was an urban development project association which was authorized by the Ulsan Metropolitan City Mayor on May 17, 2006, and the Defendant was a general urban gas business entity which was permitted to supply urban gas to Ulsan Metropolitan City under the Urban Gas Business Act, and the AMM case industry (hereinafter “MM case industry”) is an executor of the instant urban development project.

B. On June 2012, the Plaintiff, the Defendant, and the IMM industry drafted a written agreement with the following terms for the supply of urban gas with no strong movable property:

(hereinafter referred to as the “instant agreement”). The Plaintiff, the Defendant, and the IMM industry agree to the agreement on the supply of urban gas without movable property to supply urban gas without strong movable property as follows:

1. The plaintiff shall pay the city gas pipeline construction works and the facility contributions incurred from the construction in the future to the following land, and the IMM industry shall provide the following land to the defendant:

- Two lots of 43 Bridges (general commercial area 332.6 square meters) in Ulsan-gu, Ulsan Metropolitan City

2.The above price of the land shall be the appraised value.

C. According to the instant agreement, on October 10, 2012, the Plaintiff changed the name of the owner on the register of land allotted by the authorities in recompense for development outlay for development outlay 332.6 square meters of land (hereinafter “instant development recompense”) located within the boundary of 43B block 2 lot 332.6 square meters (hereinafter “instant development recompense for development outlay”) from the Plaintiff to the Defendant.
