A defendant shall be punished by imprisonment for not less than one year and six months.

Of the facts charged in the instant case, the fraud of the purchase price on June 1, 2006 shall be acquitted.

Punishment of the crime

1. Around December 26, 2003, the Defendant purchased the purchase price fraud in the name of the Defendant’s wife C at KRW 4060,000,000 forest land in Gwangju City and KRW 29,000,000.

On April 13, 2004, the Defendant borrowed KRW 2.7 billion from E, used it as the purchase price of the said forest, and completed the registration of ownership transfer in C. On the same day, the Defendant created a right to collateral security of KRW 4 billion with respect to the said forest in the creditor E.

However, as the defendant failed to pay the principal and interest of the above obligation properly, the decision to commence the auction was made on November 11, 2004 with the creditor E's application and the auction was under way.

On July 10, 2005, the Defendant purchased the purchase price of KRW 100,00 from the Defendant on March 24, 2004, the amount of KRW 220,000 among G G in Gwangju City, where the present auction is being conducted, for KRW 200,00,000, the Defendant would cancel the auction with the money, divide the land, and transfer ownership to the Party by cancelling the collateral security established on the forest. If the transfer of ownership is known, on March 24, 2004, the victims of KRW 230,000,000 as to the G forest in Gwangju, where the Plaintiff had been sold the entire forest and field, and paid KRW 10,00,000,000 to H as a brokerage commission, together with the interest on KRW 270,000,000,000,000.

However, in fact, the above KRW 200 million was insufficient to revoke the auction, and the Defendant did not have any intent or ability to cancel the right to collateral security established in the above woodland and transfer the right to the victim’s future ownership. At the same time, the said woodland was set up a collateral security worth of KRW 4 billion.05 billion.
