1. The Plaintiff:
A. Defendant B is KRW 65,00,000 and the interest rate of KRW 15% per annum from June 21, 2017 to the date of full payment.
Reasons
Facts of recognition
On February 19, 2016, the Plaintiff, by the brokerage of Defendant C, as a licensed real estate agent, leased 203 units of the real estate indicated in the attached Table (hereinafter “instant multi-family house”) which is the multi-family house owned by Defendant B from Defendant B (hereinafter “instant multi-family house”), with the lease deposit of KRW 65 million, and the lease period from February 28, 2016 to February 27, 2018.
(hereinafter “instant lease agreement”). After the Plaintiff paid the said lease deposit to Defendant B, the Plaintiff made a move-in report on February 29, 2016 and received a fixed date.
The confirmation and explanatory note of the object of brokerage delivered by Defendant C while mediating the instant lease agreement to the Plaintiff is indicated in the column for “matters of rights other than ownership” in the entries in the registry as follows: “(1) the maximum debt amount of the land and building is KRW 4550 million (B) and KRW 70 million (D303) in the building; (2) the lease deposit is KRW 70 million in the building; and (3) the term “matters of rights other than the actual relation of rights or matters of rights not publicly notified” is indicated in the column for “the total deposit of the tenants in the building.”
On January 24, 2018, the instant multi-family house and its site (Ean 454.5 square meters in Chungcheongnam-si), the auction of real estate was conducted (Cheongju District Court Support F for Chungcheong District Court), and the court prepared a distribution schedule with the following details.
Accordingly, the Plaintiff did not receive any distribution.
